Terms & Conditions - Services & Digital Products
These Terms & Conditions set out the commitment of Megan Ferguson, trading as Megan Elizabeth Coaching (ABN 98 403 125 978) (“Megan Elizabeth Coaching,” “we,” “us”), to provide clear guidelines on the use of our coaching services, training, consulting programs, digital products, and memberships.
These Terms & Conditions apply to all coaching, training, consulting, and digital products provided by Megan Elizabeth Coaching, including but not limited to:
One-on-one coaching
Group coaching
Coaching intensives
Strategy sessions
Problem Solver Sessions
Online and in-person training
Workshop facilitation
Memberships
Digital coaching products
By purchasing or participating in any of our services or products, you confirm that you have had the opportunity to review these Terms & Conditions, that you have read and accepted them, and that you consent to the conditions outlined within.
1. Coaching Services & Digital Products
1.1 Description of Services
Megan Elizabeth Coaching offers a range of coaching, training, and consulting services, including one-on-one coaching, group coaching, coaching intensives, strategy sessions, problem solver sessions, online and in-person training, workshop facilitation, and digital coaching products.
Services are described in detail on the relevant sales pages, invoices, or contracts.
All coaching programs include the outlined features at the time of purchase. Additional features may be offered at the discretion of Megan Elizabeth Coaching but are not guaranteed.
2. Payment & Pricing
2.1 Payment Terms
Prices are displayed in AUD (Australian Dollars) and do not include GST unless stated otherwise.
Payments are processed via Stripe, Acuity Scheduling, or other payment platforms. In some cases, invoices may be issued.
Full payment is required upfront unless a payment plan is agreed upon at the time of purchase.
2.2 Subscription & Recurring Payments
Monthly coaching subscriptions will automatically renew unless cancelled by the client.
Cancellations must be processed through the relevant payment platform. A written request must be submitted at least 7 days prior to the next billing cycle via email to megan@meganelizabethcoaching.com.
Failure to send notification of cancellation at least 7 days prior to the billing cycle may result in the next payment being processed. Refunds are at the discretion of Megan Elizabeth Coaching.
Clients will retain access to their coaching services until the end of their current billing cycle. No partial refunds or pro-rata refunds will be provided for unused time within the billing period.
Unused coaching hours will be carried forward while the coaching subscription is still active. If the subscription is cancelled, all unused coaching hours will be forfeited at the end of the billing cycle.
3. Refunds & Cancellations
3.1 Coaching Services Refunds
Megan Elizabeth Coaching offers a 30-day, 100% Money-Back Guarantee for coaching programs if the client is unsatisfied with their experience.
To request a refund, clients must email megan@meganelizabethcoaching.com within 30 days of their first payment.
After 30 days, all payments are non-refundable, and payment plans must be completed, even if the client chooses not to continue the coaching program.
3.2 Digital Products Refunds
All purchases of digital products, memberships, courses, or downloadable content are final and non-refundable, unless otherwise specified in writing by Megan Elizabeth Coaching.
The Success Files provides 6 months of guaranteed access from the date of purchase. After this period, access cannot be guaranteed if the product is discontinued or removed. If this occurs, all purchasers will be notified in advance.
3.3 Coaching Session Cancellations & Rescheduling
Clients must cancel or reschedule coaching sessions at least 24 hours in advance.
Sessions cancelled with less than 24 hours' notice will be forfeited, unless due to extenuating circumstances, which will be reviewed on a case-by-case basis.
If Megan Elizabeth Coaching needs to reschedule a session, every effort will be made to find a suitable alternative time for the client.
4. Client Responsibilities
4.1 Participation Terms
Coaching is a collaborative process that requires the client’s commitment. The client is responsible for implementing any insights, strategies, or action plans discussed during coaching sessions.
Coaching is not therapy or medical treatment. Clients must seek appropriate professional support for any mental health, medical, or psychological concerns.
Clients are responsible for ensuring they are physically and mentally fit to participate in coaching sessions.
4.2 Confidentiality & Privacy
All coaching sessions are confidential. Megan Elizabeth Coaching will not disclose any personal details unless required by law.
Personal data collected during coaching relationships is handled in accordance with Australian Privacy Laws. For more details, refer to the Privacy Policy.
7. Coaching Disclaimer & No Guarantees
Coaching services are intended for educational and informational purposes only. Coaching is not a substitute for therapy, financial, legal, or medical advice. While Megan Elizabeth Coaching aims to support clients, no guarantees are made regarding personal, business, or financial outcomes.
Clients acknowledge that they are solely responsible for their decisions, actions, and results.
8. Jurisdiction & Dispute Resolution
As we are based in Queensland, these terms will be governed by the laws of Queensland. In the event of any dispute, we ask that you first contact us, and we’ll do our best to resolve the dispute to our mutual satisfaction quickly, cheaply and efficiently. If we do end up in court, you agree that the exclusive venue for resolving any dispute will be in the courts of Queensland and courts of appeal from them.
9. Force Majeure
Megan Elizabeth Coaching shall not be held liable for any failure to perform its obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, technical failures, or government-imposed restrictions.
10. Right to Terminate Services
Megan Elizabeth Coaching reserves the right to terminate a coaching relationship if a client:
Fails to make timely payments
Engages in abusive, disruptive, or unethical behavior
Violates these Terms & Conditions
Fails to actively participate in coaching sessions
In such cases, no refunds will be provided, and all outstanding payments remain due.
